Legal Notice

Version of 8 November 2026. The Spanish version prevails over the French and English translations.

1. Service owner

In compliance with Article 10 of Ley 34/2002, of 11 July, de servicios de la sociedad de la información y de comercio electrónico (LSSI-CE, Spanish Information Society Services and Electronic Commerce Act), the details of the owner of MADCINE+ are as follows:

MADCINE+ is an initiative of Gabon Connect linked to the Festival Internacional de Cine de Madrid, 4th edition. The legal relationship between Gabon Connect and GABON CONNECT ESPAÑA, S.L. will be specified in the final version of this notice.

2. Purpose

MADCINE+ is a subscription video-on-demand service. It is offered on the website madcineplus.com and in the iOS and Android apps. It includes a catalogue of audiovisual works and a section dedicated to the Festival.

This notice governs access to and use of the website and the apps. The subscription contract, producer registration, participation in the Festival and the purchase of tickets are also governed by their own terms:

3. Use of the service

You agree to use MADCINE+ in accordance with the law and with these terms. In particular, you must not:

• download, record, copy or redistribute the works outside the playback function of the service;
• circumvent the technical protection measures of the content, conduct prohibited by Article 196 of Real Decreto Legislativo 1/1996 (Ley de Propiedad Intelectual, TRLPI, Spanish Intellectual Property Act);
• share the account outside the account holder's household or resell access;
• manipulate viewing statistics or the vote for the Premio del Público (Audience Award), for example with fake accounts or automated programs;
• introduce malicious software or attack the security of the service.

4. Intellectual and industrial property

The works in the catalogue belong to their rights holders. MADCINE+ distributes them under a non-exclusive licence granted by each producer.

The MADCINE+ trademark, the design of the website and the apps, our own texts and the code belong to GABON CONNECT ESPAÑA, S.L. or its licensors. They are protected by the TRLPI and by Ley 17/2001, of 7 December, de Marcas (Spanish Trademarks Act). No use of the service transfers any right over them to you, except the personal viewing right granted by the subscription.

5. Illegal content and notices

Anyone can report content they consider illegal or that infringes their rights. The notice is sent to info@madcineplus.com or through the "Denunciar" (Report) button on each work. It must state:

1. the work or content concerned and its address;
2. the reason why it is considered illegal;
3. the name and email of the person giving notice, except in the cases provided for by law;
4. a statement of good faith about the accuracy of the information.

This procedure applies Article 16 of Regulation (EU) 2022/2065 on Digital Services (DSA). MADCINE+ examines each notice, reports its decision and its reasons under Article 17 DSA, and keeps the information for the purposes of Article 6 DSA and Article 16 of the LSSI-CE on the liability of hosting providers.

6. Liability

MADCINE+ seeks to keep the service available and working properly, but does not guarantee its continuous availability. It may interrupt it for maintenance, for security or for reasons beyond its control. The rights of consumers when the digital service does not conform are set out in the Terms of Service for Viewers.

MADCINE+ is not liable for the content of third-party sites it links to, except under the terms of Article 17 of the LSSI-CE.

7. Commercial communications

MADCINE+ only sends commercial communications by email to people who have authorised them or in the cases of Article 21.2 of the LSSI-CE. Each message includes a simple, free way to unsubscribe.

8. Applicable law and jurisdiction

This notice is governed by Spanish law. If you are a consumer, the courts of your place of residence have jurisdiction, under Article 90.2 of Real Decreto Legislativo 1/2007 (TRLGDCU, Spanish Consolidated Consumer Protection Act) and Article 18 of Regulation (EU) 1215/2012. In all other cases, the courts of Madrid have jurisdiction.

9. Alternative dispute resolution

Consumers can contact an alternative dispute resolution entity accredited under Ley 7/2017, of 2 November (Spanish Alternative Consumer Dispute Resolution Act). The owner does not adhere to any alternative dispute resolution entity.. Before doing so, they can write to info@madcineplus.com, which replies within 15 days at most, under Article 21.3 of the TRLGDCU.
