These terms govern the MADCINE+ subscription between GABON CONNECT ESPAÑA, S.L., with NIF B88909304 and registered office at Calle Eduardo Chillida, 225, escalera A, 7th floor, door A, 28051 Madrid (Spain) ("MADCINE+"), and the person who subscribes ("you"). They are general terms within the meaning of Ley 7/1998, of 13 April, sobre Condiciones Generales de la Contratación (Spanish General Contract Terms Act). They apply together with Real Decreto Legislativo 1/2007, texto refundido de la Ley General para la Defensa de los Consumidores y Usuarios (TRLGDCU, Spanish Consolidated Consumer Protection Act), and with Ley 34/2002 (LSSI-CE, Spanish Information Society Services Act).
Before paying, you can read, download and save them (Article 27.4 LSSI-CE). The contract is concluded in Spanish, French or English, depending on the language you choose. MADCINE+ archives the contract and you can ask for a copy at info@madcineplus.com.
1. What the subscription includes
While it is in force, the subscription gives you access to:
- the entire MADCINE+ catalogue in streaming, on the website and in the iOS and Android apps;
- the Festival section: the works in competition at the Festival Internacional de Cine de Madrid, 4th edition, and the vote for the Premio del Público (Audience Award) under its Festival Rules.
It does not include tickets for the gala or the screening days, nor the Gala Online. These are sold separately under the Ticket Sale Terms.
The catalogue changes: producers can withdraw works and others are added. MADCINE+ does not guarantee that a specific work will remain available. A work may not be available in your country if its producer has excluded it.
2. Price
The subscription costs €0.99 per month, VAT included The VAT applied is that of the customer's country of residence.. There are no additional charges. The price is shown before you pay, as required by Article 97.1.e TRLGDCU.
Payment is made by card or other methods offered by Stripe. MADCINE+ does not know or store your card details. You will receive the invoice by email and in your account.
3. How to sign up
- You create an account with your email and a password.
- You choose the subscription and check the price.
- You accept these terms and give your express consent to the immediate start of the service (see clause 6).
- You pay on the Stripe page.
- You receive confirmation by email, with these terms and confirmation of your consent, within the period set by Article 98.7 TRLGDCU and Article 28 LSSI-CE.
Before paying, you can correct the data you entered by going back in the process (Article 27.1.c LSSI-CE).
To sign up you must be over 18 and have the legal capacity to enter into a contract.
4. Duration, renewal and cancellation
The subscription is monthly and renews automatically each month, on the same date, at the same price, unless a change is notified under clause 5.
You can cancel it at any time from "Cuenta" (Account), without penalty and without giving reasons. Cancelling is as easy as signing up. It takes effect at the end of the period already paid: you keep access until that date and the next renewal is not charged. The part of the current month is not refunded, except in the cases of clause 6 and clause 9.
If a payment fails, Stripe will retry it for 14 days. If it keeps failing, the subscription is suspended until you update your payment method.
5. Price changes
MADCINE+ may change the subscription price for objective reasons, such as changes in costs, taxes or the catalogue offer. It will notify you by email at least 30 days before the new price applies to your renewal. If you do not agree, you can cancel before that date at no cost. If you do not cancel, the new price will apply from the next renewal.
This clause complies with Articles 85.3 and 85.10 TRLGDCU, which treat as unfair a price increase without objective reasons and without a right to terminate the contract.
6. Right of withdrawal
As a consumer, you have the right to withdraw from the contract within 14 calendar days of its conclusion, without giving reasons (Articles 102 and 104 TRLGDCU).
Loss of the right when the service starts immediately. The subscription gives immediate access to digital content. When you sign up, we ask you:
- to expressly consent to access starting at that moment, before the 14 days end; and
- to acknowledge that, as a result, you lose your right of withdrawal.
If you give that consent and that acknowledgement, and MADCINE+ confirms them to you in writing under Article 98.7 TRLGDCU, you lose the right of withdrawal under Article 103.m TRLGDCU. If you do not give them, access will start when the 14 days end.
How to withdraw, when the right exists. Send a clear statement to info@madcineplus.com or use the withdrawal form in the annex. It is enough to send it within the period. MADCINE+ will refund you within 14 days at most, using the same payment method you used (Article 107 TRLGDCU).
7. Your account and profiles
The account is personal to the account holder. You can create up to 5 profiles for the people in your household. Each profile has its own list, history and language. A profile can be marked as a children's profile: it then only shows works rated for all audiences and for ages 7 and over.
The account holder is responsible for:
- keeping their password secret;
- the use made of the account and its profiles, including by minors;
- not sharing the account outside their household and not reselling access.
An account can play content on up to 2 screens at the same time.
The vote for the Premio del Público belongs to the account, not to the profile: each account votes only once per award.
8. Permitted use
The subscription gives you a personal, non-exclusive and non-transferable right to watch the works for private use, in the home. It does not allow public screening, recording, downloading outside the service's function or redistribution. Section 3 of the Legal Notice also applies.
MADCINE+ may suspend or close an account that seriously breaches these terms, for example through vote fraud, reselling access or circumventing content protection. It will inform you of the decision and its reasons beforehand, except in urgent cases or where the law prohibits it, and you will be able to respond. If it closes the account because of a breach on your part, the current period is not refunded.
9. Conformity of the service
MADCINE+ is responsible for the service conforming to the contract, under Articles 114 and following TRLGDCU. If the service does not work for a significant period for reasons attributable to MADCINE+, you can ask for it to be brought into conformity and, if that fails, for a proportional price reduction or termination of the contract.
MADCINE+ may update the service, for example its apps or its design, at no cost to you. If a change significantly harms your access to or use of the service, it will notify you in advance and you will be able to terminate the contract at no cost within the following 30 days.
10. Liability
MADCINE+ is not liable for failures of your internet connection or your devices. Nothing in these terms limits the rights the law gives you as a consumer.
11. Changes to these terms
If MADCINE+ changes these terms, it will notify you at least 30 days in advance. If you do not accept them, you can cancel at no cost before they apply.
12. Customer service, complaints, law and jurisdiction
You can write to info@madcineplus.com. MADCINE+ replies to complaints within 15 days of receipt at most (Article 21.3 TRLGDCU). Official complaint forms (hojas de reclamaciones) are available to you, which you can request by writing to info@madcineplus.com.
This contract is governed by Spanish law, without prejudice to the mandatory consumer protection rules of your country of habitual residence (Article 6 of Regulation (EC) 593/2008, Rome I). The courts of your place of residence have jurisdiction (Article 90.2 TRLGDCU and Article 18 of Regulation (EU) 1215/2012).
